Principles of personal data processing

for the provision of Ecomail application services available at https://www.ecomail.cz/ .

The aim of this document will be to familiarize you with all the information related to the processing of your personal data. We recommend that you read these principles of personal data processing. If you have any further questions regarding the processing of your personal data, please contact us at support@ecomail.cz or by mail at the above address.

We process your personal data for reasons established by law, for the purpose of fulfilling the contract or on the basis of our legitimate interest. If personal data is not processed for any of these three reasons, then we will ask for your consent. We ensure that your personal data is processed in accordance with the following principles:

  • reasonable limits , this means that we use your personal data to the extent necessary to fulfill the purpose for which they are provided;
  • transparency , in other words we inform you in advance what personal data we process, why, for how long and to whom we transfer your personal data; a
  • security , we always work with technologies and internal procedures so that your personal data is safe; it goes without saying that we monitor, evaluate and accept our internal settings in accordance with the development of modern technologies.

For whom these policies are intended. Unless otherwise stated, this privacy policy applies to persons who:

  • use the Ecomail Application and related services;
  • they visit websites operated by us;
  • they voluntarily register to participate in online or offline events.

For better clarity and orientation, terms that are often repeated in these principles are listed below.

Application is a software service containing, in particular, tools for editing e-mails and mass sending them and evaluating campaigns, available on the websites https://www.ecomail.cz/ and/or https://www.ecomail.app/ ;
GDPR Regulation (EU) 2016/679 of the European Parliament and of the Council;
Business communication as a rule, an e-mail message or sms sent for the purpose of promoting similar products and services, either from the User Recipients or from Ecomail to those who have agreed to it in advance or to customers;
Personal data any information about the User, on the basis of which it can be directly or indirectly identified;
Recipient’s personal data any information about the Recipient, on the basis of which it can be directly or indirectly identified, we process this information for our customer as a processor;
Recipient the natural person to whom the Recipient’s Personal Data relates will most often be a customer of the User and at the same time a recipient of the Business Communication;
Contract any contract for the provision of Ecomail services, whether directly provided through the Application or only in connection with it;
User the natural person to whom the Personal Data relates will most often be a customer or a potential customer , possibly a user of our website, or a participant in our online or offline events, also referred to as ” You “;
Processor performs personal data processing activities on the basis of a contract or other authorization for the administrator (Ecomail);
Processing of personal data is any operation or set of operations with personal data or sets of personal data that is carried out with or without the aid of automated procedures, such as collection, recording, arrangement, structuring, storage, adaptation or alteration, retrieval, inspection, use, disclosure by transmission, dissemination or any other disclosure, arrangement or combination, restriction, erasure or destruction;
Special categories of personal data such personal data that indicate racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health status, or the sex life or sexual orientation of a natural person. Genetic and biometric data are also considered a special category of data if they are processed for the purpose of unique identification of a natural person;

Ecomail acts not only as the administrator of the Personal Data of its customers, potential customers and users of the website https://www.ecomail.cz/ or https://www.ecomail.app/ , but also as a processor of the Personal Data of Recipients of Business Communications and other communications sent through the Application.

  1. WHEN ECOMAIL IS THE ADMINISTRATOR AND WHERE YOU CAN CONTACT US
    Ecomail administrator. The controller of personal data is the company ECOMAIL.CZ, s.r.o. , with registered office at Na Zderaze 1275/15, Nové Město, 120 00 Prague 2, ID number: 02762943, registered at the Municipal Court in Prague, section C, file 223183, represented by Jakub Stupka, managing director (hereinafter also just ” we ” or ” administrator “).

    Please note that this privacy policy will apply to the Processing of personal data of our Users, not the Recipients.
  2. WHEN IS ECOMAIL THE PROCESSOR AND WHERE YOU CAN CONTACT US
    Ecomail processor. Ecomail provides services according to the Agreement to its customers, who can use the Application to send Business Messages or other information and thus remain in contact with Recipients. If we process the Personal Data of the Recipients, then we do so on behalf of our customers only as a processor, in accordance with the instructions of our customers. If you are a Recipient of Business Communications from one of our customers, we recommend that you carefully read their documentation regarding the processing of Recipients’ Personal Data. In it, you should find out how this customer collects and uses information about you (Recipients). If our customer has provided us with the Recipient’s Personal Data and you wish to exercise all rights, please contact the relevant customer directly. Our employees have limited access to the Recipient’s Personal Data. If you still wish to submit your request regarding the exercise of rights regarding the Recipient’s Personal Data directly to Ecomail, please also state the name of our customer. We will forward your request to this customer as soon as possible.
  3. WHAT PERSONAL DATA WE PROCESS
    We process the following Personal Data about you:
    • first and last name,
    • contact details (especially e-mail, telephone number),
    • the number of email contacts in your database;
    • the name of your website or e-shop;
    • invoicing data and bank connection (data necessary for accounting and making payments for services provided),
    • information that you give us as part of communication with us (in particular, it will be about your questions and answers to your questions, communication with you),
    • operational data indicating mainly the occurrence of an error state of the Application (time and address of the occurrence of the error incident);
    • user account name,
    • login to the user account and behavior in the user account (especially data filled in by the user in the application, time of registration, date of last profile update),
    • IP address,
    • cookies.

    We do not process Special categories of personal data.
  4. HOW WE PROCESS PERSONAL DATA
    Generally at the time of Personal Data Processing. We process your personal data to the extent necessary for the entire duration of the Agreement, and then for the necessary period after its termination. Specific processing times can be seen from point 6 of these Principles. At this time, we are obliged to stop processing personal data; if we evaluate that it is necessary to archive Personal Data or that it is necessary to process it for a longer period of time, especially for the purpose of protecting our rights and legitimate interests (e.g. exercising rights from defects in the provided Application service as part of a claim or a filed complaint, or asserting another claim, etc. ) Please note that in some cases the period for Personal Data Processing can be up to 15 years after the fulfillment of the Contract due to the protection of our interests.
  5. FOR WHAT PURPOSE DO WE PROCESS PERSONAL DATA
    Registration, setting up a user account. You voluntarily provide us with Personal Data by setting up a user account for the Application and subsequently updating it. Thanks to your user account, you can use the services of the Application.
    Information about behavior in the Application. We may receive information about how and when you use the Application, store it in log files or other types of files associated with your account, and link it to other information it collects about you. This information may include, for example, your IP address, time, date, browser used and actions you have taken in the Application, as well as content you have uploaded to the Application.
    Data processing associated with the security of the Application. If you visit our website or when using the Application, a situation may arise where access to a certain address will be unauthorized or cause an error condition (incident).
    Websites. We also process information about when you visit and view our website. This information may include e.g. IP address, date and time of access to our website, information about your internet browser, operating system or language settings. We can also look into the history of your behavior on the website or in the Application, e.g. which links on our website you visit and which offered Services are shown to you. However, information about your behavior on the web is anonymized for the sake of your maximum privacy.
    If you access our website from a mobile phone or similar device, we can also process information about your mobile device (data about your mobile phone, etc.)
    We may collect this data as part of a protocol or by using cookies or other tracking technologies.
    Personal data obtained automatically or by contractual partners. We can process Personal Data from publicly available sources, our contractual partners and combine them with Personal Data that are voluntarily provided to us. We take steps to ensure that third parties are legally authorized to provide this information to us. For example it will be about demographic information, IP addresses and cookie files. The reason is to improve the provision of our services and the promotion of our services.
    Personalized advertising. We work with third parties to manage and display our advertising on third party websites.
    Blog. We have a publicly accessible blog on our website. Please note that any information you post in a comment on our blog can be viewed by anyone. If your Personal Data appears on our blog and you are interested in removing it, please contact us at support@ecomail.cz . If we are unable to remove your Personal Data from the blog, we will inform you about this and tell you the reason.
    Competitions and other promotional events. We may conduct surveys, organize contests or other promotional events on our website or through social networks. Your participation in our promotions is voluntary. As part of these surveys, competitions and promotions, we may request Personal Data from you, e.g. first and last name, address, date of birth, telephone number, e-mail address, user name and similar data. We will use the personal data you provide us to manage these promotions or for other purposes, if this is stated in the terms of a specific promotion.
    Social networks. We have a profile on Facebook, Instagram, Twitter and LinkedIn. Any information, communication or materials that are provided through the social media platform are also provided in accordance with the personal data processing principles of these platforms.
    Registration to receive the Business Communication (newsletter). If you register for our newsletter, we will send you interesting information related to the operation of the Application. If you no longer want to receive e-mails, click on the unsubscribe link in the footer of each of our e-mails.
    Register for the Ecomail changelog subscription. Any visitor to our website or User can register in our Ecomail changelog. We will send you a regular overview of corrections and improvements in the Application. If you subscribe to the Ecomail changelog, then we will not send you our newsletters if you are not our customer. If you no longer want to receive e-mails regarding the Ecomail changelog, click on the unsubscribe link in the footer of each of our e-mails.
    Business communication for our customers (newsletter). If you have concluded a contractual relationship with us, especially based on the Contract, we have the right to send you a Commercial Communication based on our legitimate interest in promoting our services and/or related similar services. If you no longer want to receive e-mails, click on the unsubscribe link in the footer of each of our e-mails. You can also object to the sending of newsletters (more in the section dedicated to your rights).
    Different types of business messages. Sometimes we can send you a newsletter according to your previously expressed preferences (news, changelog, offline events, etc.) In the case of unsubscribing, you can only unsubscribe from one type of newsletter. If you do not wish to receive any e-mails from us, please write to support@ecomail.cz and we will remove your personal data from all databases.
    Transactional emails. There are messages that we send to Users in connection with the use and proper operation of the Application. It is not used to promote the Application or related services. For example, we may notify you of temporary or permanent changes to our services, such as scheduled maintenance, new features, version updates, releases, abuse warnings, and changes to our privacy policy.
    Sometimes it can happen that you receive such an e-mail from our contractual partner – typically it can be a platform that we use for the administration of trainings or webinars, when we need to deliver a notification to you about the start or progress of such an event.
    Communication with customer support or other questions. If you contacted us by e-mail, by telephone or within the contact form on our website or on social networks, then we process your personal data for the purpose of handling the inquiry.
    Training and other events. We organize trainings, seminars, webinars and workshops. We process your Personal Data, which you fill in the order form. We process this data for the purpose of fulfilling the contract, i.e. your participation in the event. Please note that we may take video or photographs of some of these events. The video recording of the event will be used for the participants of the event, but also for other people to view. We will use photos from these events for the purpose of our further promotion. We strive for maximum anonymity, so we will not include your name or other data in photos and videos, unless you give us your consent (e.g. if it is a reference). If you are not interested in recording your photo or video, please contact us before the event at support@ecomail.cz or in person directly before the event at the venue.
    Card payment. If you provide us with your credit card details, we do not have access to the complete details. We only know that you pay by card and the card data is processed by the recipients of this data, who process the payment for us.

    We understand that it is sometimes difficult for you to wade through the amount of text devoted to how, why we process your Personal Data and where we obtain it.   7. CHECKING THE CONTENT OF SENT E-MAILS TO RECIPIENTS
    If the User sends an e-mail to the Recipient, the Internet travels on the network and the server administrator can read the content of this message. Therefore, please note that e-mail is not intended for sending confidential information, and most e-mails are delivered to the “inbox” box and are not encrypted in any way. Do not use the services of our Application to send confidential information.
    Sometimes we may review the content of our Users’ email campaigns to ensure that they comply with our terms of use of the Application and legal regulations. Our employees can check your individual e-mail campaigns randomly for this purpose. The set control mechanism is an advantage for all our Users who comply with our conditions for using the Application, as such a procedure reduces the amount of junk mail (spam) sent through our servers and helps us maintain high deliverability of your e-mail campaigns (low spam rate) and for those who comply with the applicable legislation.
  8. OUR ACCOUNTING AND TAX OBLIGATIONS
    Please note that we process a number of personal data for reasons for which we are legally obliged to do so. Pursuant to § 31 of the Accounting Act (No. 593/1991 Coll.), we are obliged to archive accounting documents and accounting records (invoices) for a period of 5 years starting from the end of the accounting period to which they relate. We also have an obligation arising from § 47 of the Act on the Administration of Taxes and Fees (No. 337/1992 Coll.) to keep the invoice for a period of 3 years from the end of the tax period in which the tax liability related to the invoice arose. The invoice contains the following personal data: name, surname, e-mail address, billing address, or other identification of the User and records of the services provided by us within the Application.
    Please also note that according to § 35 of the Value Added Tax Act (No. 235/2004 Coll.), we have the obligation to archive tax documents for a period of 10 years from the end of the tax period in which the performance took place. The tax document contains the following personal data: name, surname, e-mail address, billing address, or other identification of the User and records of services provided by us within the Application.
  9. WHAT MEASURES WE HAVE TAKEN TO PROTECT YOUR PERSONAL DATA
    Technical and safety measures. With regard to the probability of risks and the ratio between the price of possible measures as well as technical options, we have introduced technical security and organizational measures – in all areas where personal data is processed (especially website operation, application operation, employee agenda, communication with customers ).
    We use a secure information system that provides personal data security corresponding to the state of the art, costs, nature, scope and purposes of processing.
    Organizational measures. All employees who have access to Personal Data are bound by confidentiality and must respect security principles. Access to all systems, including the information system, is personalized and protected by passwords that are created in different ways. The information system records logs so that we can control the access of individual employees to individual databases. Employees are regularly trained.
  10. WHEN WE PROVIDE YOUR PERSONAL DATA TO THIRD PARTIES

Your Personal Data may be transferred to our business partners (Processors) or other third parties, if required by law.

Processors. We only use verified Processors, with whom we have a written contract, and who provide us with at least the same guarantees as we provide you. These are only Processors who are from the European Union or with whom we have concluded standard contractual clauses in accordance with Art. 46 of the GDPR and who provide your Personal Data with a comparable level of protection as in the case of the use of the GDPR and Czech legal regulations. All these Processors of ours are bound by confidentiality obligations and may not use the provided Personal Data for any purposes other than those for which we have made them available in accordance with those principles. We have listed specific Processors for each individual reason and purpose of Personal Data Processing.

Google API. If when using the Ecomail Service, information and Personal Data will be transferred from the Google API interface to any other application, then the use of this service will be governed by the Google API Service Policy , including requirements for limiting the use of this service.

Legal obligations Personal data may be transferred to third parties outside the Processor, if required by law or in response to legal requirements of public authorities or at the request of a court in legal disputes.

  1. WHAT RIGHTS YOU HAVE

It is possible to ask us for access to personal data and to request correction, change, deletion or restriction of processing of personal data where it is inaccurate or has been processed in violation of applicable laws on the protection of personal data. You have the right to portability of personal data, to object to the processing of personal data, the right to withdraw consent to the processing of personal data and the right not to be subject to automated individual decision-making, including profiling.

Your rights regarding the processing of Personal Data can be exercised by e-mail at support@ecomail.cz , in person or by post at the administrator’s address.

We strive to be able to comply with your requests immediately, but within 1 week at the latest. However, there may be circumstances in which we cannot provide access (for example, if the requested information threatens the privacy of other persons or other legitimate rights, or where the costs of providing access would be disproportionate to the risks threatening the privacy of the individual in the given case). We may take reasonable steps to verify the user’s identity before taking any action to protect the rights of the Data Users.

Right to access personal data

According to Art. 15 GDPR, you will have the right to access personal data, which includes the right to obtain from the controller:

  • confirmation of whether it processes personal data,
  • information about the purposes of the processing, the categories of personal data concerned, the recipients to whom the personal data were or will be made available, the planned period of processing, the existence of the right to request from the administrator the correction or deletion of personal data concerning Users or the restriction of their processing or to object to this processing, the right file a complaint with the supervisory authority, about all available information about the source of personal data, if they are not obtained from Users, about the fact that automated decision-making takes place, including profiling, about appropriate guarantees when transferring data outside the European Union,
  • in the event that the rights and freedoms of other persons are not adversely affected, as well as a copy of personal data.

In the event of a repeated request, the administrator will be entitled to charge a reasonable fee for a copy of personal data.

The right to correct inaccurate data

According to Art. 16 GDPR you have the right to correct inaccurate personal data. You are also obliged to report changes to your personal data (e.g. user profile registration). At the same time, you are obliged to cooperate if it is found that the personal data we process is not accurate. We will carry out the repair without unnecessary delay, but always taking into account the given technical possibilities.

Right to erasure

According to Art. 17 GDPR, you have the right to delete personal data concerning you, if we do not prove legitimate reasons for processing this personal data. We have set up mechanisms to ensure automatic anonymization or deletion of personal data in the event that they are no longer needed for the purpose for which they were processed.

Right to restriction of processing

According to Art. 18 GDPR, you have the right to restrict processing until the complaint is resolved, if you deny the accuracy of personal data, the reasons for their processing or if you object to their processing.

Right to notification of correction, erasure or limitation of processing

According to Art. 19 GDPR, you have the right to be notified in the event of correction, deletion or restriction of personal data processing. If correction or deletion of personal data occurs, we will inform individual recipients, except in cases where this proves impossible or requires unreasonable effort.

The right to portability of personal data

According to Art. 20 GDPR, you have the right to the portability of data concerning you that you have provided to the administrator in a structured, commonly used and machine-readable format, and the right to request the transfer of this data to another administrator.

If you provide personal data in connection with our contractual obligations or on the basis of consent and their processing is performed automatically, you have the right to receive such data in a structured, commonly used and machine-readable format. If it is technically feasible, the data can also be transferred to the administrator designated by you, if the person acting for the relevant administrator is properly designated and it is possible to authorize him.

If the exercise of this right could adversely affect the rights and freedoms of third parties, your request cannot be granted.

The right to object to the processing of personal data

According to Art. 21 GDPR, you have the right to object to the processing of your personal data due to legitimate interest.

If we do not prove that there is a serious, legitimate reason for the processing that outweighs your interests or rights and freedoms, we will terminate the processing based on the objection without unnecessary delay.
